*Considering the case of serial killer Cyanide Mohan, or Mohan Kumar, as rarest of the rare, the Fourth Additional District and Sessions Court of Mangalore sentenced him to death in three cases on Saturday. *
The court convicted him in the cases of three women namely, Barimaru Anitha and Leela from Bantwal taluk and Sunanda from Sullia taluk.
Pronouncing the judgment in the jam-packed court hall, Judge B K Naik convicted Mohan with death penalty under Section 302 of the IPC, based on what he termed as "the balancesheet of aggrevating and mitigating circumstances based on the facts and evidence of the case.'
Mohan Kumar, a government school teacher from Kanyana in Bantwal taluk, had deceived women in three separate cases and had promised them of marriage.
Upon having forceful sexual intercourse with them in lodges in other districts, he would administer cyanide and brutally kill them before fleeing from the spot with their gold ornaments. Apart from the three cases in which he was sentenced on Saturday, he has been chargesheeted in 17 similar cases and is undergoing trial.
In the 125-page-long order copy, the judge sentenced him to five-year rigorous imprisonment and imposed Rs 5,000 penalty under Section 366 of IPC (kidnap), eight-year RI and Rs 5,000 penalty under Section 376 of IPC (sexual assault), death penalty under Section 302 (murder), five year rigorous imprisonment (RI) and penalty of Rs 5,000 under Section 392 (robbery), 10-year RI and penalty of Rs 10,000 under Section 394 (causing hurt in committing robbery), sixmonth RI and penalty of Rs 1,000 under Section 328 (administering poison), one-year rigorous imprisonment under Section 465 (forgery), three-year RI and penalty of Rs 2,000 under Section 468 (forgery for purpose of cheating), three year RI under Section 473 (making or possessing counterfeit seal) and three-year RI and penalty of Rs 3,000 under Section 201 (destroying evidence). He has been imposed with same punishment in all the three cases.
Rejecting the plea of leniency sought by convict Mohan Kumar on the grounds of his family members being dependent on him, the judge said there is not even a single mitigating circumstance that will come to the aid of the accused and no leniency would given to him considering the brutality of the crime he has committed. He has killed three innocent, unmarried and young women which is beyond the imagination of the ordinary man. Such brutal killing pricks the conscience of the society, he stated.
Expressing happiness over the judgment, Special Public Prosecutor Cheyyabba Beary called it historic and said it was a warning to society.
