Jiah Khan case: HC stays trial against Sooraj The Bombay High Court yesterday stayed the trial against actor Sooraj Pancholi, accused of abetting actress Jiah Khan’s suicide, and set aside June 7 as the next date on which it will hear a petition filed by the Jiah’s mother Rabia seeking Special Investigation Team (SIT) probe into the case. A vacation bench comprising Justices BR Gavai and Shalini Phansalkar-Joshi stayed the trail.

On May 20, the special women’s court had adjourned the trial till June 10 after Rabia sought to move Bombay High Court seeking stay in the trial following the pending hearing of her petition.

In her petition before the HC, Rabia sought SIT probe alleging that CBI, which is presently investigating the case, had concurred with the findings of Mumbai police that it was a suicide case and not homicidal death.

According to Rabia, CBI, ‘due to reasons best known to it’, has been vehemently opposing the appointment of special public prosecutor in the case by Maharashtra government.

“The High Court yesterday accepted our arguments that earlier also the trial was stayed in the case by the regular bench of HC, but later refused to extend the stay. Following this, Rabia approached the Supreme Court which on May 17 asked her to once again petition before the high court and asked it to expedite the matter,” said Subhash Jha, Rabia’s advocate.

The CBI prosecutor, while opposing the bail, told the court that since Peter is influential, he can tamper with evidence. He further added that CBI has enough evidence against him.

In his plea, Peter mentioned that he had no issues with the relationship shared between his son Rahul and Sheena. This refutes what the CBI had alleged in the supplementary charge sheet, which stated that Sheena’s murder took place because Peter was unhappy with the affair and the impending marriage.

The bail plea quotes an e-mail exchange between Peter and his friend on November 25 and 26 2011.

“I wish them both well and hope they are happy and comfortable. i love him dearly and i like sheena very much too,” wrote Peter reportedly in the mail to his friend.

Most of these houses are from the chief minister’s quota but were never allotted by the then CM Prithviraj Chavan. “The prices for the CM quota homes haven’t been calculated yet, but it’s a given fact that the rates will be less, as the flats were built earlier,” said T Matkar, from the marketing department of MHADA C Dange, joint chief officer of the Mumbai board of MHADA, said, “We have a formula to decide the prices of the flats and the same formula shall be used for selling the CM quota homes too.”

This formula is based on the cost of land, construction and other factors from the period of construction. “So,in the case of a home from the CM quota in 2010, the price shall also be from that period. Only the taxes shall be applicable at current rates,” said a senior official.

MHADA will be come out with the advertisement for the lottery by the end of the month. It has been holding such lotteries every year since 2009. MHADA, being a non-profit organisation, doesn’t earn profits in most of its projects, except those that are meant for Higher Income Groups, and even then the margin is minimal.

The summons that was issued on May 20 had asked them to come to Mumbai and record their statements. Divya Pahuja, the mole that gave out the location of Sandeep is also in the docks.

A team of Haryana police, led by sub inspector Pradyuman Yadav, murdered Gadoli on February 7 in Andheri’s Hotel Airport Metro around 11 pm.

His family has demanded fair investigation and has refused to take back his body, which is still lying in JJ hospital mortuary. The Bombay High Court in March had rejected Sandeep’s brother Kuldeep’s plea to file a FIR against the cops, after which he approached the Supreme Court. The next hearing is scheduled on May 27 in the apex court.

*Gold allocation rises*
She also ordered increase in gold allocation for women beneficiaries from 4 to 8 grams under the Thallikku Thangam Scheme (Gold for Mangalsutra). From now on, beneficiaries will get eight grams of gold in addition to monetary assistance of Rs 25,000 to Rs 50,000.

*Waiver of crop loans*
She first signed a file, ordering waiver of crop loans upto March 31, 2016 payable to co-operative banks. The waiver would entail a financial burden of Rs 5,780 crore on her government.

*Free power*
100 units of free power for domestic electricity consumers with effect from yesterday in tune with the present tariff computation. It would entail an additional payout of Rs 1,607 crore as grant by the state government.

*Liquor*
She ordered closure of 500 Tamil Nadu State Marketing Corporation-run retail liquor outlets and cut short working hours of bars. On Saturday five Lashkar terrorists were killed in a 9-hour long operation in Drugmulla village. The operation was conducted by the local police and 41 Rashtriya Rifles. Three jawans were injured in the operation in which Gawade sustained bullet injuries on his face.

Hailing from Amboli village in Sindhudurg district, Gawade enrolled in The Maratha Light Infantry on September 21, 2001. For the past one year he was operating in 41 RR and had participated in numerous anti-militancy operations in the treacherous areas of Kupwara district. He is survived by wife Pranjal and two sons, Prajwal (5) and four-months-old Vedant. Naik Gawade had returned from leave and rejoined the unit on February 25.

Pranjal said, “My husband was a brave soldier who would volunteer for daredevil missions against the militants in the valley, and his friends praised him for his skills. He wanted our two sons to study a lot, join the defence forces, and serve India. We celebrated our elder son, Prajwal’s fifth birthday in February, and this was the first time he was there for his birthday. After two days we arranged the naming ceremony of our other son Vedant, who is just four-months-old.”

Gawade’s elder brother Ganpat has retired from the Army and now assists their father on his farm, while their youngest brother Ashok is also in the Army and has come for a vacation.

Ashok said, “Three of us brothers were in the Army but amongst us, he was the most technically sound person in the field. Our sister had come to spend her holidays when we called him on Saturday and he spoke to every one of us. We are proud of our brother.”

Gawade’s mortal remains will be flown from Srinagar to New Delhi and to Goa today. From Goa by road they will be brought to Amboli village in Sindhudurg district which is around 100 kilometres away.

mid-day editorial: No, Chris Gayle, sexism is not funny West Indies cricketer Chris Gayle has tried to laugh off the uproar over his outrageously sexist remarks to a female journalist, Charlotte Edwards. Gayle sparked a furore after he asked the scribe how many black men she had slept with, whether she has had a threesome, whether her hair is dyed (while flicking his eyes downwards). His words — “I have a big, big bat, the biggest in the wooooorld… you will need two hands to lift it” — have now become the stuff of lewd legend.

Notwithstanding his big bat, Gayle has been unable to deflect the heavy criticism and instead dubbed the negative reaction as ‘racism’. Never mind that this is the second time Gayle made inappropriate comments to a female reporter. In January, he had propositioned broadcaster Mel McLaughlin live on air in January, asking her if she would like to go out for a drink with him, then adding, “Don’t blush, baby.” He was widely condemned for that incident as well, but clearly, he learned nothing.

Gayle, the father of a little girl, said that it was just a joke, but he was being made a scapegoat because he is a successful black man. According to him, none of this criticism would have happened if a white footballer had made the same remarks. The West Indies batsman might know how to rack up the runs, but he has shown that his IQ is not strong as his cricket score.

What Gayle should have done was to offer an apology straight up, and what he has failed to do now is keep his trap shut. Gayle needs to realise that as a cricketer, whether in the IPL or when he’s playing for West Indies, he is the ambassador for his nation. The big-hitting cricketer is an idol to many, and needs to conduct himself with more dignity and maturity.

But Gayle will only learn from his mistakes when he is made to suffer consequences. Cricket boards need to impose fines that pinch, and not just let him off with a rap on the knuckles. He won’t find that so funny.

As per the statement issued by the BMC yesterday, all assistant municipal commissioners (ward officers) and deputy municipal commissioners (DMCs) will have to conduct rigorous supervision of the de-silting work in their respective wards to ensure its completion before the deadline. The decision was taken at a review meeting that took place between the civic chief and senior staffers.

In addition, Mehta would be conducting surprise checks to gauge the progress of the de-silting work. He also directed the staffers to complete the work on minor nullahs by Wednesday. All zonal DMCs will be responsible for the completion of work in their wards.

The long wait for the government to make good on its word has left Batose cynical. For the town planners, the village, with 350 hutments across just 1 km, has been a blind spot. It lacks even basic facilities like adequate water. Harsh summers only make matters worse.

*Plodding on*

The City and Industrial Development Corporation of Maharashtra, the town planning agency of Navi Mumbai, supplies water to the village through a 60,000-litre tank from 6.30 am-7 am each day, but that is barely enough for the population of 3,000. “On an average, one tap supplies water to 10 houses. We get just four to five buckets of water, which is reserved for drinking. How are we supposed to carry on with our day-to-day activities?” complains Jadhav. Residents have no go but to trudge 2-3 km to other villages, scouting for water.

*The back of beyond*
It’s the sharp dichotomy within a developing Kharghar that’s riled up the villagers. Owe Camp is just 5 km from the Kharghar railway station, but is nowhere on the growth map.

Jadhav alleges that several residential complexes in the city centre, in contrast, receive 24x7 water. “The government had neglected all along. No one is ready to hear our problems,” he rues.

Among the many assurances made by the government, only a municipal school has come up in the village over the years. “We don’t have our own gram panchayat. For revenue, funds and other works, we have to depend on the Owe gram panchayat (GP), which has five villages under its jurisdiction. Tribal communities in forests 10 km from our village are better off than us and get basic facilities, at least,” alleges Maruti Salunke, a senior citizen.

The water pipeline to the village was laid only in 2011. Supply is also erratic, says Pandurang Rewane, a resident and former member of the Owe GP. “Three times a week, there are issues with water supply.”

*Solution under their nose*
Owe Camp is just 500 m from the famous Pandavkada falls. Jadhav suggests that water from it be stored during monsoons for use during summers. “Millions of litres of water at the falls go to waste during the monsoon. This can be used for the village later.”*The dangerous trek*
Mandabai Raghunath Rewane (48), a resident of Owe Camp village had set out, with two steel cans and a flashlight, around 5 pm and had managed to score some water from a borewell of a private firm in a nearby village around three hours later.*Mandabai Rewane*

“It was dark. There were some pieces of wire on the ground that I didn’t see. My leg got trapped in them and I fell down, cutting myself on the steel cans. There were two other women with me and they took me to the hospital. I had to get five stitches,” she says. The eight-member Rewane family has to make do with just two cans of water in a day.

On January 9, the Malwani police had found the body of Rubeena aka Ruby Qureshi, in the mangroves near Dharoli village at Aksa beach. The naked body had been bundled in a sack, with her hands and legs tied with a rope. There were also several injuries on her head and signs that she had been strangled to death. The investigation also established that she had been raped after the murder. The cops registered the case on January 16, but her kin were unable to identify her body as it was bloated and disfigured due to high tide.

*Finally identified*
The woman was finally identified as the 21-year-old Rubeena, who was living in Malwani with her husband, Azaad Qureshi, who runs a catering business at Ambuj wadi. The main accused was identified as Azaad’s elder brother, Raees Qureshi (26). His accomplices were identified as another brother-in-law Ishaque Qureshi (55, married to the sister of Azaad and Raees) and a friend, Gulam Rasool alias Shabbir (23).

Rubeena and Azaad hail from Badaun in UP but they had eloped and settled in Delhi. Their families were against the marriage, especially Raees and this made them shift to Mumbai. During interrogation, the accused revealed that after few months, the family came to terms with the marriage, and Raees began visiting them in Malwani.

Whenever Azaad was not at home, Raees would make sexual advances towards Rubeena but was thwarted each time. She had complained to her husband too, but he refused to believe her. Meanwhile, Raees got fed up of constant rejection and decided to kill her.

Azaad was away from home on January 3, when Raees and his accomplices attacked Rubeena. After they killed her, Raees had his way with her body and then called his accomplices back the next day to dump the body.

According to Inspector S Thakur from Malwani police station, Rubeena’s husband filed a complaint on the same day she went missing, but when her body was found, he could not recognise her. After a few months, the family left Mumbai and every time the police called the husband, Raees would turn up instead, and supply misleading information. It was only on Saturday that he finally admitted that he and his accomplices had committed the crime.

All three accused have been arrested under Sections 302 and 201 of the IPC. They were produced before the court and remanded to police custody till May 27. Reported by Mid-Day 15 hours ago.

According to police, Ravi and a girl were in love for the past several years. On Monday, Ravi is said to have started a discussion on marriage, when the girl allegedly turned down his proposal. A wordy duel ensued between the duo, and Ravi, in a fit of rage, is said to have stabbed her with a knife.

The severely injured girl was rushed to the town hospital by her parents. First aid was provided there and the girl was shifted to K R Hospital in Mysuru as per the doctors' advice.

*Child marriage and teenage pregnancy continue to be a major concern in India. A latest research by a non-profit organisation shows that 28% of girls in India married before the age of 18 and 59 % of the married young girls had their first child by the age of 19*.

In a sharp contrast, just 1% of the boys were married before the age of 18, according to a research conducted by the Young Lives India and Children's Investment Fund Foundation (CIFF) in collaboration with the International Center for Research on Women.

The findings were released on Tuesday here at an event followed by threadbare discussions by eminent experts, academicians and policy makers on how to deal with the problem of early marriage and teenage pregnancy in India. National Council of Protection of Child Rights chairperson Stuti Kacker unveiled two working papers—Factors Shaping Trajectories to Child & Early Marriage and Social Determinants of Early Marriage & Teenage Pregnancy.

A policy brief, titled, Tackling Child Marriage and Early Childbirth in India: lessons from Young Lives, was also released at the event.

The research findings not only highlighted the plight of the teenage girls being made to start a conjugal life and bear children at an early stage of physical and mental growth but also noted how early marriage have also deprived them of their right to education and literacy.
